Terms of Service – Client Galleries

These Terms of Service (“Terms”) govern your access to and use of any online gallery (“Gallery”) provided by Kristen Beres Photography (“Photographer,” “we,” “our,” or “us”). By accessing or using a Gallery, you (“Client,” “you,” or “your”) agree to the following:

1. Gallery Access

1.1 Each Gallery is created for the Client’s personal use and is accessible via a unique link provided by Photographer.
1.2 Clients are responsible for maintaining the confidentiality of their gallery link and any associated passwords. Photographer is not responsible for unauthorized access caused by sharing of links or login information.
1.3 Galleries are available for a limited time, as stated in the delivery email. Photographer is not obligated to maintain or archive galleries beyond the stated period.

2. Image Selection and Orders

2.1 Images displayed in the Gallery are proofs and may not represent final retouching unless otherwise specified.
2.2 Orders for prints, products, or digital downloads must be placed directly through the Gallery’s integrated store system.
2.3 Full payment is required at checkout. All sales are subject to the Photographer’s Terms of Sale and Digital Image License Agreement.

3. Personal Use License

3.1 Clients may download and use Images only as permitted by the applicable license provided (e.g., personal-use digital downloads).
3.2 Social media sharing is permitted for web-sized images where specifically provided, with credit given to Photographer (e.g., tagging Instagram: @kristen.beres, Facebook: Kristen Beres Photography).
3.3 Any use of Images for commercial purposes (advertising, marketing, resale, publication) requires a separate written licensing agreement.

4. Intellectual Property

4.1 All Images remain the sole intellectual property of Photographer and are protected under U.S. and international copyright laws.
4.2 Unauthorized reproduction, editing, scanning, or distribution of Images outside the scope of the granted license is strictly prohibited.

5. Privacy and Sharing

5.1 Photographer may, with Client’s prior consent, use selected Images from the Gallery for marketing, portfolio, or promotional purposes.
5.2 Clients may request that their Gallery be password-protected or remain private. Photographer will make reasonable efforts to honor such requests.

6. Technical Issues

6.1 Photographer is not liable for interruptions in access to the Gallery due to internet outages, hosting provider issues, or technical errors beyond our control.
6.2 Clients are encouraged to download and back up their purchased Images promptly, as Gallery availability is time-limited.

7. Limitation of Liability

Photographer’s liability for any claim relating to the Gallery or its contents is limited to the fees actually paid by Client for the session or the specific Products purchased through the Gallery.

8. Governing Law

These Terms are governed by and construed under the laws of the State of Rhode Island, without regard to conflict of law principles.
